Circumstances That Require

Granting Family or Medical Leave



When covered employers receive a request for leave from eligible employees, it must be granted in the following situations:

1. For the birth and care of a newborn child;

2. For the placement of a child for adoption or foster care;

3. For the care of the employee’s spouse, child, or parent with a serious health condition; and

4. For a serious health condition that makes the employee unable to perform the functions of the employee’s job.

(Note: The law applies equally to male and female employees.)
